Padgett v. Donald 41 F.3d 1253 (11th Circuit 2005) FACTS Procedural: The United States and Georgia Constitutions allow the Georgia Department of Corrections to compel incarcerated felons to submit saliva samples for DNA profiling, pursuant with O.C.G.A. section 24-4-60. The district court granted summary judgement in favor of the Commissioner of the Georgia Department of Corrections, the Georgia Bureau of Investigation, and the Georgia Department of Corrections. The statute does not violate the Fourth Amendment, the search and seizure provisions of the Georgia Constitution, or the felon’s rights to privacy under the United States or Georgia Constitutions, and was affirmed. Substantive: In 2000, the Georgia General Assembly amended O.C.G.A. section 24-4-60 (â€Å"the statute†) to require people that are convicted of felonies and incarcerated for felony crimes to provide a sample of DNA to the Georgia Department of Corrections (â€Å"GDOC†) for analysis and storage in a data bank that is maintained by the Georgia Bureau of Investigation (â€Å"GBI†). The DNA profiles can be released from the bank â€Å"to federal, state, and local law enforcement officers upon a request made in furtherance of an official investigation of any criminal offense.† The statute applies to anyone convicted of a felony and incarcerated on or after July 1st, 2000.
